Hi Khalid,
Welcome to The Logo Company. You have a great question there and it is one that comes up on a regular basis and can seem confusing to many people.
We do not provide any kind of copyright or trademark services. No web based logo design companies do. We do have some links in our link directory http://thelogocompany.net/logo-design-partners/trademark-copyright.html that point to one or two resources that specialize in copyright law and trademark registration.
Just briefly ...this is our responsibility: We will design you a logo from the information that you provide to us on the order form. We do not do any research into whether or not the design has been trademarked before because it is a custom design. It is highly unlikely although possible that the design we supply has been designed by another designer and copyrighted. I say highly unlikely because designs that are custom are built from the ground up. The odds of two designers coming up with the same design are astronomical to say the least.
This is your responsibility: If you want to trademark the design then you need to research that yourself with a specialist that deals with trademarks. Just follow the resources in our directory that I linked to earlier. We take NO responsibility for trademark issues you may encounter. No logo design company does unless you are dealing with say Saatchi and Saatchi where they have a separate division set up to do this. The price is obviously reflected in the service.
When we have finished your logo design we hand over any rights that we had to the copyright of the design. Providing we have full payment for the design then YOU will own the copyright that previously belonged to us as the designer. This is common practice in design. Some companies put conditions on this copyright transfer like for instance...they still hold the right to display your new logo in their portfolio.
The Logo Company does not tie your hands together like this. Of course we love to display your new logo in our portfolio...but we do not hold this as our divine right. We ask the client if we can do it and if the client agrees then fantastic. If not...that is fantastic too. It is the clients logo design to do with as they please.
I hope that clarifies this confusing topic. Trade marking and copyrights are often very closely related that is why I explain about both issues.
